Binding Financial Agreements
A Binding Financial Agreement (BFA) is an agreement made before, during or after the relationship is established between the married couples or de-facto partners. It states how your assets, financial resources and liabilities should be divided if the relationship fails.

Who can apply for a divorce?

You must have been separated for at least 12 months and one day
-
You must be an Australian citizen by birth, descent or by grant of Australian citizenship, or
-
Live in Australia and have done so for 12 months immediately before filing for divorce, or
-
regard Australia as your home and intend to live in Australia indefinitely
If you satisfy the above criteria, we can assist you with the preparation/lodgement of your application to its finalisation in Court. You can choose to apply for a divorce with your spouse as a joint applicant, or by yourself as a sole applicant. The granting of a divorce does not result in a decision about property and maintenance or parenting arrangements for your dependants. We are able to advise you on the best arrangement for these issues.
